ScientiMax Learning Programs Inc. (“ScientiMax”, “we”, “us”, or “our”) is committed to maintaining a learning environment that is respectful, inclusive, professional, safe, and free from harassment, discrimination, bullying, intimidation, retaliation, and other inappropriate conduct.

All students, instructors, contractors, employees, volunteers, guests, institutional partners, and other participants are expected to contribute to a positive educational environment that promotes dignity, mutual respect, professionalism, and equal opportunity.

This policy establishes expectations for conduct and outlines procedures for addressing concerns relating to harassment, discrimination, bullying, retaliation, and related misconduct.

1. Scope

This policy applies to:

  • Students;
  • Prospective students;
  • Former students participating in ScientiMax activities;
  • Instructors;
  • Contractors;
  • Employees;
  • Volunteers;
  • Institutional partners;
  • Guests; and
  • Other individuals participating in ScientiMax programs, services, events, simulations, assessments, communications, or educational activities.

This policy applies to conduct occurring:

  • On the ScientiMax website;
  • Within learning management systems;
  • During courses and assessments;
  • During AI-powered simulations;
  • Through email communications;
  • Through discussion forums, chats, messaging systems, and video conferencing platforms;
  • During educational events; and
  • In any context reasonably connected to ScientiMax activities.

2. Commitment to Equality and Inclusion

ScientiMax is committed to providing educational services in a manner consistent with applicable human rights legislation, including the British Columbia Human Rights Code.

ScientiMax does not tolerate discrimination based on any protected characteristic recognized by applicable law.

All individuals are entitled to participate in ScientiMax activities with dignity, respect, and equal opportunity.

3. Prohibited Conduct

The following conduct is prohibited.

Harassment

Harassment includes unwelcome conduct that a reasonable person would consider intimidating, hostile, degrading, humiliating, abusive, or offensive.

Examples may include:

  • Repeated unwelcome comments;
  • Insults or personal attacks;
  • Offensive jokes;
  • Derogatory remarks;
  • Intimidation;
  • Threats;
  • Persistent unwanted communications; or
  • Conduct that creates a hostile learning environment.

Sexual Harassment

Sexual harassment includes unwelcome conduct of a sexual nature that creates an intimidating, hostile, humiliating, degrading, or offensive learning environment, or that is used as a basis for decisions affecting a student’s participation, standing, or access to educational services.

Examples may include:

  • Unwelcome sexual comments, jokes, or advances;
  • Unwelcome requests for sexual favours, sexual attention, romantic involvement, or other conduct of a sexual nature;
  • Display, transmission, or distribution of sexually offensive materials; or
  • Any other conduct of a sexual nature that a reasonable person would find unwelcome or offensive.

Discrimination

Discrimination includes adverse treatment based on a characteristic protected by applicable human rights legislation, including but not limited to race, colour, ancestry, place of origin, religion, marital status, family status, physical or mental disability, sex, sexual orientation, gender identity or expression, and age.

Bullying

Bullying includes repeated behaviour intended to intimidate, embarrass, isolate, humiliate, undermine, or harm another person.

Retaliation

Retaliation includes adverse treatment directed toward an individual because they:

  • Submitted a complaint or report;
  • Participated in an investigation;
  • Reported misconduct in good faith; or
  • Exercised rights under ScientiMax policies or applicable law.

Retaliation is strictly prohibited.

4. Online Conduct

Because ScientiMax operates primarily through digital platforms, students and participants must communicate professionally in all online environments.

Prohibited online conduct includes:

  • Harassing or abusive messages;
  • Threatening communications;
  • Hate speech;
  • Doxxing or sharing personal information without authorization;
  • Cyberbullying;
  • Cyberstalking;
  • Impersonation; or
  • Disruptive conduct that interferes with educational activities.

5. Academic and Professional Respect

Participants are expected to:

  • Communicate respectfully;
  • Consider differing viewpoints professionally;
  • Provide constructive feedback;
  • Avoid personal attacks;
  • Respect instructors, staff, and fellow students; and
  • Contribute positively to the learning environment.

Disagreement is acceptable. Disrespectful behaviour is not.

6. Reporting Concerns

Individuals who experience or witness conduct that may violate this policy are encouraged to report the matter as soon as reasonably practicable and ideally within sixty (60) calendar days of the incident.

Reports should include:

  • Description of the incident;
  • Relevant dates;
  • Individuals involved; and
  • Supporting information where available.

ScientiMax will acknowledge receipt of a report within five (5) business days and will endeavour to provide a substantive response within fifteen (15) business days following acknowledgement.

Where additional time is required due to the complexity of the matter or the nature of the investigation, ScientiMax will notify the reporting individual and provide an updated timeline.

External Escalation

Individuals who are not satisfied with ScientiMax’s response, or who wish to pursue external recourse, may file a complaint with the British Columbia Human Rights Tribunal where appropriate.

Individuals should be aware that external complaint deadlines may apply, including the time limits established under the British Columbia Human Rights Code.

7. Investigation Process

ScientiMax may:

  • Review communications and correspondence;
  • Review platform and access records;
  • Interview relevant individuals;
  • Request additional information from any party; and
  • Take other reasonable investigative steps.

Investigations will be conducted fairly, impartially, and confidentially to the extent reasonably possible.

Individuals who are the subject of allegations will be provided an opportunity to respond to relevant allegations before a final determination is made, where reasonably practicable and consistent with procedural fairness.

8. Interim Measures

Where reasonably necessary, ScientiMax may implement temporary measures while an investigation is ongoing, including:

  • Communication restrictions;
  • Temporary suspension of account access;
  • Administrative controls; or
  • Other reasonable measures intended to protect participants and maintain a safe learning environment.

In circumstances involving immediate safety, security, harassment, threats, discrimination, retaliation, or serious disruption concerns, ScientiMax may implement interim measures immediately and without prior notice where reasonably necessary.

Interim measures are not disciplinary findings and do not constitute a determination of fault.

Interim measures will be reviewed periodically and lifted when no longer reasonably necessary in the circumstances.

9. Corrective Actions

Where a violation is substantiated, ScientiMax may impose one or more corrective actions, including:

  • Verbal or written warning;
  • Educational intervention;
  • Removal from specific activities;
  • Temporary suspension;
  • Permanent removal from programs;
  • Account termination;
  • Revocation, suspension, correction, or invalidation of certificates or credentials where appropriate; or
  • Legal action where warranted.

Corrective actions will be proportionate to the nature and severity of the conduct.

10. Appeals

An individual who disagrees with a corrective action decision may submit a written appeal within sixty (60) calendar days of the decision.

Appeals must be submitted to in**@********ax.ca.

The appeal should identify:

  • The corrective action being appealed;
  • The grounds for the appeal; and
  • Any additional information or documentation supporting reconsideration.

Appeals will be reviewed by an individual who was not the primary decision-maker in the original matter, where reasonably practicable.

11. Confidentiality

ScientiMax will make reasonable efforts to protect the confidentiality of all individuals involved in a report or investigation.

Absolute confidentiality cannot be guaranteed where disclosure is necessary to investigate, resolve, enforce ScientiMax policies, protect legal rights, protect participant safety, or comply with applicable legal obligations.

12. Records Retention

ScientiMax may retain reports, complaints, investigation materials, correspondence, findings, decisions, appeal records, and related documentation for up to seven (7) years following resolution of the matter, or longer where required by law, regulatory requirements, litigation holds, or ongoing legal proceedings.

13. False or Malicious Allegations

Knowingly false, malicious, or intentionally misleading allegations may themselves constitute misconduct subject to corrective action under this policy.

This provision shall not be interpreted in a manner that discourages, restricts, or penalizes good-faith reporting.

14. Statutory Rights

Nothing in this policy limits, excludes, waives, or replaces rights or remedies available under applicable human rights, employment, consumer protection, privacy, contract, or other legislation.

Where applicable law requires a different process or outcome, ScientiMax will comply with that legal requirement.

15. Governing Law

This policy shall be governed by and interpreted in accordance with the laws of the Province of British Columbia and the applicable laws of Canada.

16. Policy Updates

ScientiMax may revise this policy from time to time to reflect changes in legal requirements, business practices, technologies, educational operations, or organizational needs.

Updated versions will be published on the ScientiMax website and become effective on the date specified in the revised version.

The version in effect at the time of the reported conduct shall govern the matter unless otherwise required by applicable law.
